Object Of Trade Union:-
The main object of the Act is to provide machinery for registration of Trade Unions. The term 'Trade Union' used in the Act is not confined to workers' union, but also includes employers' association as well. The Act also prescribes the object for which a trade union may spend its general funds and also provides for the constitution of a separate fund for political purposes. Its main object is to ensure industrial harmony. The members of registered Trade Unions are protected from various civil and criminal liabilities.
Scheme of Trade Union:-
The Trade Unions Act, 1926 contained 33 Sections divided into five chapters. Chapter I containing Sections 1 and 2 deal with preliminary aspects viz. title, extent and application under Section 1 and Section 2 defines various terms under the Act viz., Trade Union, Workmen, Trade, business etc. Chapter II containing Sections 3 to 14 lays down the provisions relating to registration of trade unions. Chapter III containing Sections 15 to 28 deals with rights and liabilities of the registered trade unions. Chapter IV containing Sections 29 and 30 delegates/confers power on the appropriate Government to make regulations. In exercise of the powers conferred under Sec. 29, the Central Government enacted "The Trade Unions Regulations, 1938", while the State Governments also were empowered to enact the Trade Union Regulations of the respective states. Finally, chapter V of the Act containing Sections 31 to 33 provides for the penalties and procedure.
Trade Union: Meaning and Definition
The expression "Trade Unio. is commonly understood as 'an association of wage earners/workers'. It is a voluntary association of workers in a particular industry or a craft. According to Chambers' Encyclopaedia, Vol. XIII, 725, "a Trade Union is an association of wage earners, formed primarily for the purpose of collective action for the forwarding or defence of its professional interest. According to LJ.Hanson, a trade union is essentially an organisation of the workers. In the words of N.M.Joshi, a well known trade unionist, "a trade union is essentially an organisation of employees, not of employers, not of co-partners, not of independent workers".
Webbs defines trade union as, "it is a continuous association of wage earners for the purpose of maintaining or improving the conditions of their working lives". The statutory definition of the term 'trade union' is borrowed from the British Trade Union Acts of 1871, 1875 and 1913.
